Work permit in the Republic of Belarus

According to the Law of the Republic of Belarus “On External Labor Migration”, a foreigner who does not have a permanent residence permit in Belarus and intends to carry out labor activity must obtain a special permit for the right to engage in labor activity in the Republic of Belarus in the relevant citizenship and migration unit, as well as without fail to conclude an employment contract with the tenant.

Obtaining a work permit is not necessary for foreigners:

A special permit is issued to a foreigner at the request of the employer. If a foreigner intends to carry out labor activities with several employers, then he is obliged to apply for a work permit for each of them.

To obtain special permission, the employer must provide the following documents to the Citizenship and Migration Directorate of the Central Internal Affairs Directorate of the Minsk City Executive Committee, the Internal Affairs Directorate of the Regional Executive Committees:

A highly skilled worker is a foreigner who has a high level of professional knowledge and skills, confirmed by documents on education and work experience in the specialty for at least five years, and also the amount of the monthly wage specified in the employment contract for these workers must exceed fifteen times the minimum monthly wage established in the Republic of Belarus.

The term for consideration of documents in the Department of Citizenship and Migration of the Central Internal Affairs Directorate of the Minsk City Executive Committee and the Internal Affairs Directorate of the regional executive committees is 15 days.

A special permit for the right to engage in labor activities in the Republic of Belarus is issued for a period of up to 1 year, for highly qualified specialists - up to 2 years.

It is important to remember that before applying to the appropriate department on citizenship and migration for issuing a work permit to a foreigner, the employer must take all steps to find an employee among citizens of the Republic of Belarus. That is, the employer must first contact the employment authorities with information about the available vacancy.

After 15 days after this vacancy is brought to the attention of Belarusian citizens, the employer has the right to apply for a work permit to a foreigner, provided that no applicants were found among citizens of the Republic of Belarus. If the employer has not taken action to find an employee among Belarusians, the citizenship and migration units have the right to refuse to issue a work permit to a foreigner.

Subsequently, with a one-time extension of a work permit, the employer does not need to contact the employment authorities and publish information about a free vacancy, and the state fee for reviewing documents on the extension of a work permit will be 3 basic units.

Employment issues for citizens of the Republic of Kazakhstan, the Republic of Armenia, the Kyrgyz Republic, as well as citizens of the Russian Federation, in the Republic of Belarus are regulated by the Treaty on the Eurasian Economic Union. The working people of these states carry out labor activities on the basis of a labor or civil law contract without obtaining special permission to carry out labor activities on the territory of the Republic of Belarus.
